These Terms and Conditions (“Terms”) govern your use of the Soulbound Books LLC website located at www.soulboundbooks.com (“Site”) and any purchases you make through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Soulbound Books LLC is an independent bookstore located at 112 West Main St., Waunakee, WI 53597. We sell physical books through our Site and refer customers to Libro.fm for audiobooks and Bookshop.org for e-books.

2. Use of the Website

By using the Site, you represent that you are at least 13 years old (or have parental consent) and agree to use the Site only for lawful purposes. You agree not to:

  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Use automated tools (bots, scrapers, crawlers) to extract data from the Site without express written permission
  • Transmit any harmful, fraudulent, deceptive, or unlawful content through the Site
  • Reproduce, distribute, or commercially exploit Site content without authorization
  • Engage in any activity that disrupts or interferes with the operation of the Site

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for conduct that violates these Terms or is otherwise harmful to us, other users, or third parties.

3. Purchases — Physical Books

A. Orders and Pricing

All prices are listed in U.S. dollars. We reserve the right to correct pricing errors at any time. If an item is priced incorrectly, we will contact you before processing your order and give you the option to proceed at the corrected price or cancel. Prices displayed are exclusive of applicable taxes and shipping.

B. Order Confirmation and Acceptance

Placing an order constitutes an offer to purchase. Your order is accepted — and a binding contract formed — when we send you a shipping confirmation email. We reserve the right to decline or cancel any order for reasons including but not limited to: product unavailability, suspected fraud, or pricing errors.

C. Payment

We accept major credit and debit cards and any other payment methods displayed at checkout. Payment is processed at the time of order. Your payment information is handled by our PCI-DSS compliant payment processor and is not stored on our servers.

D. Shipping and Risk of Loss

We ship to addresses within the United States. Estimated shipping times are provided at checkout and are approximations only. Title and risk of loss for all physical book orders pass to you upon delivery to the shipping carrier.

E. Returns and Refunds

Physical books in new, unread condition may be returned within 30 days of delivery for a full refund to the original payment method. Please contact us at info@soulboundbooks.com to initiate a return. The customer is responsible for return shipping costs unless the item was damaged or incorrect. We reserve the right to refuse returns of items returned in damaged or unsellable condition.

4. Third-Party Platforms — Audiobooks and E-Books

Soulbound Books LLC does not directly sell digital content. Audiobooks are available through Libro.fm, and e-books are available through Bookshop.org. By clicking links to these platforms, you will leave our Site and enter a transaction governed solely by those third parties’ terms and conditions and privacy policies.

Soulbound Books LLC is not a party to any transaction completed on Libro.fm or Bookshop.org, and we have no liability for the products, services, availability, content, or data practices of those platforms. We encourage you to review their terms and policies before purchasing.

5. Intellectual Property

All content on the Site — including text, graphics, logos, images, and the overall “look and feel” — is owned by or licensed to Soulbound Books LLC and is protected by U.S. copyright and trademark law. You may view and print content from the Site for your personal, non-commercial use only. You may not reproduce, republish, distribute, or create derivative works from Site content without our express written permission.

Book cover images and publisher content are the property of their respective publishers or rights holders and are used for informational purposes consistent with fair use.

6. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Book descriptions provided on the Site are supplied by publishers or distributors; we do not independently verify their accuracy and disclaim responsibility for any inaccuracies therein.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOULBOUND BOOKS LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you paid to us for the transaction giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Soulbound Books LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party rights.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference and available at www.soulboundbooks.com/privacy-policy. Our Privacy Policy reflects our commitment to reader privacy and the responsible handling of your personal information.

10. Links to Third-Party Websites and External Services

The Site contains links to third-party websites and platforms, including but not limited to Libro.fm (audiobooks) and Bookshop.org (e-books). These links are provided for your convenience only. When you follow a link to any external site or platform, you are leaving the Soulbound Books LLC website and your use of that site is governed entirely by that site’s own terms of service, privacy policy, and other applicable policies — not ours.

Soulbound Books LLC has no control over the content, availability, accuracy, data practices, or privacy practices of any third-party websites or services, and we accept no responsibility or liability for them. The inclusion of any link does not imply our endorsement of the linked site or any association with its operators. We encourage you to review the terms and privacy policies of every external site or service you visit before submitting personal information or completing a transaction.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in Dane County, Wisconsin.

Informal Resolution. Before filing any claim in court (other than the exceptions listed below), the party with the grievance must provide the other party written notice describing the dispute in reasonable detail (email to info@soulboundbooks.com is sufficient). The parties agree to attempt to resolve the dispute in good faith within thirty (30) days of that notice (the “Resolution Period”). If the dispute is not resolved within the Resolution Period, either party may pursue available legal remedies.

Exceptions. The informal resolution requirement does not apply to: (a) claims for injunctive or other equitable relief to prevent or stop actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information; or (b) claims that may be brought in small claims court in Dane County, Wisconsin, provided the matter qualifies and remains within that court’s jurisdictional limits. Either party may seek emergency injunctive relief from a court of competent jurisdiction without first completing the Resolution Period.

No Mandatory Arbitration. Nothing in these Terms requires either party to resolve disputes through binding arbitration. Each party retains the right to bring claims in a court of competent jurisdiction.

12. Modifications to the Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated Effective Date. Your continued use of the Site after the updated Terms take effect constitutes your acceptance of the changes. For material changes, we will provide at least 30 days’ notice.

13. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Soulbound Books LLC regarding your use of the Site and supersede any prior agreements on that subject.
